Find the Clue AS

1.1 The customer submits a binding offer confirming the order by clicking on the button “Order now.” A contract between the customer and Find the Clue AS is only concluded when Find the Clue AS assigns and transmits the order number. The transmission of an order confirmation is equivalent to the delivery of a ticket that allows the customer to participate in an Escape Game.
1.2 The purchase of vouchers can be cancelled as specified in paragraph 5.
1.3 After the purchase of an Escape Game ticket, cancellation or alteration of the participation date is not possible (cp. Paragraph 5.1).
2.1 The total amount of the order is due immediately after purchase via “PayPal” and “Invoice”.
2.2 If the customer chooses to “pay on site”, the total amount is due in cash on site and on the booked date before the game starts. Payment via credit card or debit card (girocard) is possible.
3.1 The ticket purchased by the customer allows them and additional registered persons to participate in an Escape Game on the date and at the hour indicated on the ticket (order confirmation).
3.2 If the customer arrives late, the duration of the game will be reduced accordingly. At a delay of 30 minutes the customer loses their right to participate in the Escape Game. The obligation to pay the total amount remains untouched in accordance with paragraph 2.
3.3 The Escape Games offered are usually not suitable for children under the age of ten. Children under ten years are therefore not allowed to participate in an Escape Game. The minimum age may vary depending on the particular Escape Room. The respective minimum age will then be indicated on the website (see room descriptions at the ticket page).
3.4 Minors under the age of 18 must be accompanied by a legal guardian or by an adult authorized in writing by a legal guardian to oversee the minors. Otherwise, participation may be denied. The person who places the order must be at least 18 years old.
4.1 Vouchers can only be redeemed for payment of a ticket allowing the participation in an Escape Game at a location offered by Find the Clue AS. Vouchers cannot be redeemed at other locations of the TeamEscape Franchise.
4.2 Find the Clue AS has no legal obligation to cash out vouchers as long as the service is offered.
4.3 Vouchers issued by Find the Clue AS expire three years after the purchasing date.
5.1 At the purchase of a ticket allowing the participation in Escape Games, Find the Clue AS and the customer conclude a contract on the delivery of services in the context of leisure time activities bound to a specific date or period of time (cp. section 312 g clause 2 no. 9, German Civil Code). In accordance with section 312 g clause 2 no. 9, German Civil Code, the client has no cancellation right, regardless of the payment method chosen. Every ticket purchase allowing the participation in an Escape Game is thus immediately binding (cf. paragraph 2.1) and obliges the customer to pay the total amount of the order to Find the Clue AS
5.2 At the purchase of a voucher with the purchasing customer or their proxy physically present (e.g. purchase on site), no distance contract is concluded according to section 312 b, German Civil Code. The customer thus has no cancellation right.
5.3 For all other voucher purchases, the following applies to all contracts with customers:
You have the right to cancel this contract within 14 days without giving reasons. This 14-day period starts with reception of the delivery by you or a third party named by you which is not the carrier. To claim your cancellation right, you must inform us,

via an unambiguous declaration (e.g. posted via mail, telefax or email) about your decision to cancel the contract. You may, but are not obliged to, use the enclosed sample cancellation form. In order to comply with the set cancellation period, it is sufficient to send the notification on your decision to claim your cancellation right by the last day of said period.
If you cancel this contract, we must refund all payments received by you immediately, or at the latest within 14 days starting from the day we received your cancellation notification. For the refund, we will use the same payment method that you used in the initial transaction, if not agreed otherwise. We will never charge additional fees in case of a refund. We can hold back the refund amount until already delivered goods are returned to us or proof of return is provided, depending on which occurs first. You must return the goods to us by mail or in person immediately or at the latest within 14 days after submitting your cancellation notification. In order to comply with the set return period, it is sufficient to send the goods by the last day of the 14-day period. You must bear all direct costs for the return. You will only have to pay for a loss in value if that loss can be traced back to damages inflicted by you that were not necessary to check the quality, characteristics and functioning of the goods.

5.4 In case of cancellation by the customer, the following applies:
Find the Clue ASdeactivates the voucher. If the voucher was paid before the cancellation, Find the Clue AS refunds the purchase price to the customer.
6.1 If the customer is a private consumer, Find the Clue AS reserves the property rights to the purchased item until the total amount of the order is paid. Respective security rights can be transferred to third parties.
6.2 If the customer is a business client acting as a business representative, a special fund under public law, or a corporate body under public law, Find the Clue AS reserves the property rights to the purchased item until all open claims from the business relationship with the customer are paid. Respective security rights can be transferred to third parties.
7.1 The customer shall only be entitled to offset against claims if the counterclaims have not been contested or are recognized by declaratory judgment or Find the Clue AS.
7.2 The customer shall only be entitled to a right of retention if the counterclaim is a direct result of the same contractual relationship.
8.1 Find the Clue AS has unlimited liability in the following cases:
- under the product liability law
- for damages caused intentionally or through gross negligence
- for fraudulent non-disclosure of defects
- for damages from injuries to life, limb or health
- for damages from violating a warranty
8.2 If a violation of essential contractual obligations (cardinal obligations) results from minor negligence, Find the Clue AS’s liability is limited to compensation for foreseeable damages and damages typical for the contract.
8.3 Find the Clue AS has no liability for damages caused by minor negligence, except in those cases defined in paragraphs 8.1 and 8.2.
8.4 If the liability of Find the Clue AS is excluded or limited according to paragraphs 8.1 to 8.3, this also includes liability of their vicarious agents..
9.1 The law of the Federal Republic of Germany shall apply exclusively. If the customer is a consumer residing outside the Federal Republic of Germany, they may at any point refer to the legislation of their state of residence or common domicile.
9.2 If the customer is a business client according to section 14 of the German Civil Code, the exclusive place of performance for delivery, service and payment is the Find the Clue AS office.

Consumers can use this platform to resolve their disputes out-of-court.
By entering the premises of Find the Clue AS, customers and visitors acknowledge the following house rules regulated under private law:
- Persons bearing fascist and/or contemptuous emblems, brands and/or behaving in a fascist and/or contemptuous or inhuman manner will be banned from the premises immediately and permanently.
- Any weapons, including edge weapons, guns, and knives, are prohibited on the premises.
- Taking photographs, videos, or any kind of media recording for commercial use on the premises without explicit prior permission by Find the Clue AS is prohibited. We furthermore ask you kindly to hand in any recording devices, especially cell phones, before the game starts in order to enhance the gaming experience.
- Animals are not allowed on the premises for their own safety and that of customers.
- Visitors who
- are obviously under the influence of alcohol or drugs,
- are suspected to suffer from an infectious disease according to the Federal Infection Protection Act or similar hazardous diseases,
can be denied access to the premises.
- Designated emergency escape routes and exits must not be blocked in any way or altered in their function. All escape routes are to be kept clear at all times, emergency doors must only be opened in the case of an emergency.
