1 Conclusion of Contract, Cancellation

1.1 The customer submits a binding offer confirming the order by clicking on the button “Order now.” A contract between the customer and Teambuilding GmbH NRW - TeamEscape is only concluded when Teambuilding GmbH NRW - TeamEscape assigns and transmits the order number. The transmission of an order confirmation is equivalent to the delivery of a ticket that allows the customer to participate in an Escape Game.  
1.2 The purchase of vouchers can be cancelled as specified in paragraph 5.
1.3 After the purchase of an Escape Game ticket, cancellation or alteration of the participation date is not possible (cp. Paragraph 5.1).

 

2 Pricing & Payment Methods

2.1 The total amount of the order is due immediately after purchase via “PayPal”, “Sofortüberweisung”, and “Invoice”.
2.2 If the customer chooses to “pay on site”, the total amount is due in cash on site and on the booked date before the game starts. Payment via credit card or debit card (girocard) is possible.

 

3 “Admission Tickets“

3.1 The ticket purchased by the customer allows them and additional registered persons to participate in an Escape Game on the date and at the hour indicated on the ticket (order confirmation).  
3.2 If the customer arrives late, the duration of the game will be reduced accordingly. Should the customer fail to appear the customer loses their right to participate in the Escape Game. The obligation to pay the total amount remains untouched in accordance with paragraph 2.
3.3 The Escape Games offered are usually not suitable for children under the age of ten. Children under ten years are therefore not allowed to participate in an Escape Game. The minimum age may vary depending on the particular Escape Room. The respective minimum age will then be indicated on the website (see room descriptions at the ticket page).
3.4 For playing a room, minors under the age of 14 must be accompanied by a legal guardian or by an adult authorized in writing by a legal guardian to oversee the minors. Otherwise, participation may be denied. The person who places the order must be at least 18 years old.
3.5 For playing the outdoor adventure "Operation Mindfall" minors under the age of 18 must be accompanied by a legal guardian or by an adult authorized in writing by a legal guardian to oversee the minors. Otherwise, participation may be denied. The person who places the order must be at least 18 years old.

 

4 Vouchers

4.1 Vouchers can only be redeemed for payment of a ticket allowing the participation in an Escape Game at a location offered by Teambuilding GmbH NRW - TeamEscape. Vouchers cannot be redeemed at other locations of the TeamEscape Franchise.  
4.2 Teambuilding GmbH NRW - TeamEscape has no legal obligation to cash out vouchers as long as the service is offered.  
4.3 Vouchers issued by Teambuilding GmbH NRW - TeamEscape expire three years after the purchasing date.

 

5 Cancellation Right and Sample Cancellation Form

5.1 At the purchase of a ticket allowing the participation in Escape Games, Teambuilding GmbH NRW - TeamEscape and the customer conclude a contract on the delivery of services in the context of leisure time activities bound to a specific date or period of time (cp. section 312 g clause 2 no. 9, German Civil Code). In accordance with section 312 g clause 2 no. 9, German Civil Code, the client has no cancellation right, regardless of the payment method chosen. Every ticket purchase allowing the participation in an Escape Game is thus immediately binding (cf. paragraph 2.1) and obliges the customer to pay the total amount of the order to Teambuilding GmbH NRW - TeamEscape
5.2 At the purchase of a voucher with the purchasing customer or their proxy physically present (e.g. purchase on site), no distance contract is concluded according to section 312 b, German Civil Code. The customer thus has no cancellation right.
5.3 For all other voucher purchases, the following applies to all contracts with customers:

You have the right to cancel this contract within 14 days without giving reasons. This 14-day period starts with reception of the delivery by you or a third party named by you which is not the carrier. To claim your cancellation right, you must inform us,

via an unambiguous declaration (e.g. posted via mail, telefax or email) about your decision to cancel the contract. You may, but are not obliged to, use the enclosed sample cancellation form. In order to comply with the set cancellation period, it is sufficient to send the notification on your decision to claim your cancellation right by the last day of said period.

 

After the Cancellation

If you cancel this contract, we must refund all payments received by you immediately, or at the latest within 14 days starting from the day we received your cancellation notification. For the refund, we will use the same payment method that you used in the initial transaction, if not agreed otherwise. We will never charge additional fees in case of a refund. We can hold back the refund amount until already delivered goods are returned to us or proof of return is provided, depending on which occurs first. You must return the goods to us by mail or in person immediately or at the latest within 14 days after submitting your cancellation notification. In order to comply with the set return period, it is sufficient to send the goods by the last day of the 14-day period. You must bear all direct costs for the return. You will only have to pay for a loss in value if that loss can be traced back to damages inflicted by you that were not necessary to check the quality, characteristics and functioning of the goods.

5.4 n case of cancellation by the customer, the following applies:  
Teambuilding GmbH NRW - TeamEscapedeactivates the voucher. If the voucher was paid before the cancellation, Teambuilding GmbH NRW - TeamEscape refunds the purchase price to the customer.

 

6 Retention of Title

6.1 If the customer is a private consumer, Teambuilding GmbH NRW - TeamEscape reserves the property rights to the purchased item until the total amount of the order is paid. Respective security rights can be transferred to third parties.  
6.2 If the customer is a business client acting as a business representative, a special fund under public law, or a corporate body under public law, Teambuilding GmbH NRW - TeamEscape reserves the property rights to the purchased item until all open claims from the business relationship with the customer are paid. Respective security rights can be transferred to third parties.  

 

7 Offset agreements; right of retention for purchases on account

7.1 The customer shall only be entitled to offset against claims if the counterclaims have not been contested or are recognized by declaratory judgment or Teambuilding GmbH NRW - TeamEscape. 
7.2 The customer shall only be entitled to a right of retention if the counterclaim is a direct result of the same contractual relationship. 

 

8 Limitation of liability, exclusion of withdrawal when certain obligations are violated

8.1 Teambuilding GmbH NRW - TeamEscape has unlimited liability in the following cases:

- under the product liability law
- for damages caused intentionally or through gross negligence
- for fraudulent non-disclosure of defects
- for damages from injuries to life, limb or health
- for damages from violating a warranty 

8.2 If a violation of essential contractual obligations (cardinal obligations) results from minor negligence, Teambuilding GmbH NRW - TeamEscape’s liability is limited to compensation for foreseeable damages and damages typical for the contract.
8.3 Teambuilding GmbH NRW - TeamEscape has no liability for damages caused by minor negligence, except in those cases defined in paragraphs 8.1 and 8.2.
8.4 If the liability of Teambuilding GmbH NRW - TeamEscape is excluded or limited according to paragraphs 8.1 to 8.3, this also includes liability of their vicarious agents..

 

9 Choice of law, place of performance, out-of-court settlement

9.1 The law of the Federal Republic of Germany shall apply exclusively. If the customer is a consumer residing outside the Federal Republic of Germany, they may at any point refer to the legislation of their state of residence or common domicile.  
9.2 If the customer is a business client according to section 14 of the German Civil Code, the exclusive place of performance for delivery, service and payment is the Teambuilding GmbH NRW - TeamEscape office.
9.3 The European Commission provides a platform for online dispute resolution (ODR), which can be found here: 
www.ec.europa.eu/consumers/odr

Consumers can use this platform to resolve their disputes out-of-court.

 

10 House Rules TeamEscape Essen

By entering the premises of Teambuilding GmbH NRW - TeamEscape, customers and visitors acknowledge the following house rules regulated under private law: 

  1. Persons bearing fascist and/or contemptuous emblems, brands and/or behaving in a fascist and/or contemptuous or inhuman manner will be banned from the premises immediately and permanently.
  2. Any weapons, including edge weapons, guns, and knives, are prohibited on the premises. 
  3. Taking photographs, videos, or any kind of media recording without explicit prior permission by Teambuilding GmbH NRW - TeamEscape is prohibited. We furthermore ask you kindly to hand in any recording devices, especially cell phones, before the game starts in order to enhance the gaming experience. 
  4. Animals are not allowed on the premises for their own safety and that of customers.
  5. Visitors who
    - are obviously under the influence of alcohol or drugs,
    - are suspected to suffer from an infectious disease according to the Federal Infection Protection Act or similar hazardous diseases,
    can be denied access to the premises.  
  6. Designated emergency escape routes and exits must not be blocked in any way or altered in their function. All escape routes are to be kept clear at all times, emergency doors must only be opened in the case of an emergency.

We need your 'name' so that we can tell the gamemaster to whom the booking applies.
We need the details of your 'credit card' to arrange payment for your booking.
We need your 'name' and 'address' to confirm that you are the cardholder.
We also need your 'address' in order to be able to inform you in writing about your booking before your stay.
We may need your 'phone or mobile number' in case that we need to contact you urgently regarding your booking.
We may need your 'email address' to send you information before your game e.g. regarding your arrival and to send you your team photo after the event.
We need your 'group/participant information' so that the gamemaster can better adapt to the group. In addition, the best times can be better published in this way if desired.
We may also use this information to inform you of special offers/actions that may be of interest to you.
We may also use your IP address (Internet Protocol) to diagnose problems with our server and administer the website (monitoring visitor traffic and site usage) so that we can further develop and improve the TeamEscape website.
Part of the data is collected to ensure the proper functioning of the website. Other data can be used to analyze how visitors use the site.

What rights do you have regarding your data?

Outsourced data processing

Facebook Pixel

Our website measures conversions using visitor action pixels from Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook").
These allow the behavior of site visitors to be tracked after they click on a Facebook ad to reach the provider's website. This allows an analysis of the effectiveness of Facebook advertisements for statistical and market research purposes and their future optimization.
The data collected is anonymous to us as operators of this website and we cannot use it to draw any conclusions about our users' identities. No additional data is collected or is only collected on a voluntary basis. We only use this data to send the requested information and do not pass it on to third parties.
We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1) (a) DSGVO. MailChimp

This website uses the services of MailChimp to send newsletters. This service is provided by Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
MailChimp is a service which organizes and analyzes the distribution of newsletters. If you provide data (e.g. your email address) to subscribe to our newsletter, it will be stored on MailChimp servers in the USA.
MailChimp is certified under the EU-US Privacy Shield. The Privacy Shield is an agreement between the European Union (EU) and the US to ensure compliance with European privacy standards in the United States.
We use MailChimp to analyze our newsletter campaigns. When you open an email sent by MailChimp, a file included in the email (called a web beacon) connects to MailChimp's servers in the United States. This allows us to determine if a newsletter message has been opened and which links you click on. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type, and operating system). This information cannot be assigned to a specific recipient. It is used exclusively for the statistical analysis of our newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to your interests.

Google Web Fonts

For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

Our website accepts payments via Sofortüberweisung. The provider of this service is Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany.
Sofortüberweisung provides us with real-time payment confirmations, allowing us to begin fulfilling our end of our contract right away.
If you opt to pay using Sofortüberweisung, you will be submitting a PIN and a valid TAN to Sofort GmbH so that it can access your online banking account. Sofort GmbH will automatically check your account balance and perform the transfer to our account using the TAN you supply. It then sends an immediate transaction confirmation. After logging in, your income, the overdraft protection, and the availability of other accounts and their balances will be checked.
In addition to the PIN and TAN, the payment details you provide as well as personal information will be sent to Sofort GmbH. This personal information includes your name, address, telephone numbers, email address, IP address, and any other data required to process your payment. Cancellation Right and Sample Cancellation Form

1. At the purchase of a ticket allowing the participation in Escape Games,  Teambuilding GmbH NRW - TeamEscape and the customer conclude a contract on the delivery of services in the context of leisure time activities bound to a specific date or period of time (cp. section 312 g clause 2 no. 9, German Civil Code). In accordance with section 312 g clause 2 no. 9, German Civil Code, the client has no cancellation right, regardless of the payment method chosen. Every ticket purchase allowing the participation in an Escape Game is thus immediately binding (cf. paragraph 2.1) and obliges the customer to pay the total amount of the order to Teambuilding GmbH NRW - TeamEscape.
2. At the purchase of a voucher with the purchasing customer or their proxy physically present (e.g. purchase on site), no distance contract is concluded according to section 312 b, German Civil Code. The customer thus has no cancellation right.
3. For all other voucher purchases, the following applies to all contracts with customers:

After the Cancellation

If you cancel this contract, we must refund all payments received by you immediately, or at the latest within 14 days starting from the day we received your cancellation notification. For the refund, we will use the same payment method that you used in the initial transaction, if not agreed otherwise. We will never charge additional fees in case of a refund. We can hold back the refund amount until already delivered goods are returned to us or proof of return is provided, depending on which occurs first. You must return the goods to us by mail or in person immediately or at the latest within 14 days after submitting your cancellation notification. In order to comply with the set return period, it is sufficient to send the goods by the last day of the 14-day period. You must bear all direct costs for the return. You will only have to pay for a loss in value if that loss can be traced back to damages inflicted by you that were not necessary to check the quality, characteristics and functioning of the goods.

Teambuilding GmbH NRW - TeamEscapedeactivates the voucher. If the voucher was paid before the cancellation, Teambuilding GmbH NRW - TeamEscape refunds the purchase price to the customer.
